2. Scope and acceptance
2.1 These Terms of Use (the “Terms”) govern access to and use of the Website and of all content, services and functionality made available through it.
2.2 By accessing or using the Website you accept these Terms in full. If you do not agree with any part of them, you must not use the Website.
2.3 The Terms apply together with our Privacy Policy, Cookie Policy and Accessibility Statement, which form an integral part of them.
2.4 The Website is intended for adults. It is not directed at, and is not intended to be used by, minors (see also Article 21 of Greek Law 4624/2019, which sets the age of consent for information society services at 15).
3. Changes to these Terms
3.1 The Company may amend these Terms at any time by posting the updated version on the Website with a new “last updated” date.
3.2 Amendments take effect upon posting. Please review this page periodically. Continued use of the Website after posting constitutes acceptance of the amended Terms.
4. Nature of the content — important notices
4.1 Informational and corporate purpose. The Website is purely informational and corporate in nature. It presents the identity, activities and services of the Company as a representative and distributor of biotech and specialty pharmaceutical products. It is not an online shop; no sales, orders or supply of medicinal products or any other goods take place through it.
4.2 Not medical or pharmaceutical advice. Nothing on the Website constitutes or replaces a medical diagnosis, medical or pharmaceutical advice, treatment instructions or a recommendation. For any matter concerning your health or your medication, consult your treating physician or pharmacist. Do not change or discontinue prescribed treatment on the basis of information found on the Website.
4.3 Not advertising of medicines to the general public. Nothing on the Website constitutes or is intended to constitute advertising of prescription-only medicinal products to the general public, which is prohibited under applicable law (Directive 2001/83/EC, as transposed into Greek law by Joint Ministerial Decision DYG3a/G.P.32221/2013, together with the relevant decisions and circulars of the Greek National Organisation for Medicines, “EOF”).
4.4 Healthcare professional sections. Where the Website contains, or in future contains, sections with scientific information on prescription-only medicines, those sections are addressed exclusively to healthcare professionals. Access requires the user to confirm that capacity, and the user is responsible for the accuracy of that confirmation.
4.5 Territorial scope. Information on the Website relates to the markets in which the Company operates. Marketing authorisation status, approved indications and supply conditions for medicinal products differ from country to country. Product-related information must not be construed as promotion or supply of a product in a country where it is not authorised.
4.6 Official product information. The only authoritative and official information for any medicinal product is the approved Summary of Product Characteristics (SmPC) and Patient Information Leaflet (PIL) as published by EOF (www.eof.gr) or the European Medicines Agency (www.ema.europa.eu).
5. Permitted use
5.1 The Website may be used only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of it.
5.2 The following are expressly prohibited, by way of example and without limitation:
- using the Website in breach of applicable law or of these Terms;
- attempting unauthorised access to any system, server, database or network connected with the Website;
- introducing viruses, malware or any other code capable of harming the Website or its users;

- overloading the Website’s infrastructure (including denial-of-service attacks);
- using the Website to send unsolicited commercial communications (spam);
- altering, copying or creating derivative works from the Website’s content in breach of Section 6;
- framing or embedding the Website within a third-party site in a manner that misleads as to the origin of the content.
5.3 The Company may restrict or terminate access for any user in breach of these Terms, without prejudice to any of its legal rights.
6. Intellectual and industrial property rights
6.1 All content on the Website — including text, graphics, photographs, illustrations, video, software, design, structure and source code — is the intellectual property of the Company or of third parties who have licensed it, and is protected by Greek Law 2121/1993, applicable EU legislation and international conventions.
6.2 You may view, print individual pages and store content solely for personal, non-commercial use, provided that all attribution notices and trade marks are preserved.
6.3 Reproduction, republication, modification, distribution, transmission, commercial exploitation or the creation of derivative works, in whole or in part, is prohibited without the Company’s prior written permission.
6.4 Company names, trade marks, distinctive signs and logos appearing on the Website belong to the Company or to their respective owners. Their appearance does not grant any licence or right to use them.
6.5 Trade marks and product names of third-party companies which the Company represents or with which it cooperates are used solely for identification purposes and remain the property of their respective owners.
6.6 If you believe that content on the Website infringes your rights, please contact info@pharmachim.gr, identifying the content concerned and the legal basis of your claim.
7. Third-party links
7.1 The Website may contain links to third-party websites (for example partner companies, regulatory authorities, scientific bodies), provided for convenience only.
7.2 The Company does not control and is not responsible for the content, privacy policies or practices of those websites. You visit them at your own risk and subject to their own terms.
7.3 The presence of a link does not constitute approval, endorsement or recommendation of the linked content.
8. Contacting us through the Website
8.1 The Website provides a contact form. Data you submit is processed in accordance with our Privacy Policy.
8.2 You must provide accurate and truthful information and must not submit content that is unlawful, offensive, defamatory or infringing of third-party rights.
8.3 Do not send special categories of data — in particular health data — or confidential or sensitive business information through the contact form or by unencrypted email. For such matters, please call +30 210 3303985 so that a secure channel can be agreed.
8.4 Unsolicited ideas, suggestions or materials submitted to the Company are not treated as confidential, create no obligation of confidentiality or compensation, and may be used freely by the Company, subject to data protection law.
8.5 Sending a message does not create a contractual or other relationship between you and the Company and does not oblige the Company to respond within any particular time.
9. Reporting adverse events and quality complaints
9.1 The Website is not a pharmacovigilance channel. The contact form is not monitored around the clock and must not be used for medical emergencies. In an emergency call the National Emergency Aid Centre (EKAB) on 166, or 112.
9.2 To report an adverse event, a suspected adverse reaction or a quality defect of a medicinal product, please use the official channels:

- Pharmachim: at info@pharmachim.gr marked “Pharmacovigilance”, or by telephone on +30 210 3303985, so that the report can be forwarded without delay to the responsible department and to the marketing authorisation holder.
9.3 Information reaching the Company that constitutes an adverse event report or a quality complaint is processed and transmitted to marketing authorisation holders and competent authorities as required by pharmacovigilance legislation (Regulation (EC) 726/2004, Directive 2001/83/EC and national implementing provisions). That processing is mandatory and does not depend on your consent; see the Privacy Policy for details.
10. Data protection and cookies
10.1 Processing of personal data through the Website is governed by the General Data Protection Regulation (EU) 2016/679 (GDPR), Greek Law 4624/2019 and Greek Law 3471/2006, as in force, and is described in detail in our Privacy Policy.
10.2 The use of cookies and similar technologies is described in our Cookie Policy. Non-essential cookies are placed only with your consent, which you may withdraw at any time.
11. Disclaimer of warranties
11.1 The Website and its content are provided “as is” and “as available”. The Company makes every reasonable effort to keep content accurate, complete and up to date, but gives no warranty to that effect.
11.2 The Company does not warrant that the Website will operate uninterrupted or error-free, or that the Website or its server are free of viruses or other harmful components.
11.3 Content may contain inadvertent technical or typographical errors. The Company reserves the right to correct, amend or withdraw it without notice.
11.4 Statements regarding future developments, plans or expectations of the Company are not commitments and are subject to uncertainties.
12. Limitation of liability
12.1 To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, consequential or incidental loss, loss of profit or loss of data arising from access to, use of, or inability to use the Website, or from reliance on its content.
12.2 The limitation in clause 12.1 does not apply in cases of wilful misconduct or gross negligence by the Company, in cases of injury to life, body or health, or in any other case where limitation of liability is not permitted by mandatory law, including consumer protection legislation.
12.3 You are liable for any loss you cause to the Company through unlawful use of the Website or use in breach of these Terms.
13. Availability, maintenance and security
13.1 The Company may modify, suspend or discontinue the Website or any part of it, temporarily or permanently, with or without notice.
13.2 The Company applies reasonable technical and organisational measures to secure the Website. However, no transmission of data over the internet is entirely secure, and transmission is at your own risk.
14. Force majeure
The Company is not liable for failure to perform its obligations due to events of force majeure, that is, events beyond its reasonable control, including natural disasters, war, acts of terrorism, pandemic, strikes, telecommunications or power failures, cyber-attacks or acts of public authority.
15. Governing law and jurisdiction
15.1 These Terms are governed by Greek law.
15.2 The courts of Athens, Greece, shall have jurisdiction over any dispute arising out of or in connection with these Terms or the use of the Website.
15.3 Clause 15.2 does not affect the right of a user acting as a consumer to bring proceedings before the courts of their place of residence, nor their rights under mandatory consumer protection law, nor the availability of out-of-court dispute resolution, for example through the Greek Consumer’s Ombudsman (www.synigoroskatanaloti.gr).
16. Miscellaneous

16.2 No waiver. Failure or delay by the Company in exercising a right does not constitute a waiver of that right.
16.3 Assignment. The Company may assign its rights and obligations under these Terms to an affiliated company or a successor business. You may not assign your rights without written consent.
16.4 Language. These Terms are issued in Greek and English. In the event of any discrepancy between the two texts, the Greek text prevails.
